Decrees for Damages in New Jersey

It is not the purpose of this article to discuss all the situations in which damages are awarded by the New Jersey Court of Chancery, for all the decisions stem from one general rule, namely, that whenever a court of equity has once acquired jurisdiction of a cause, it will retain such cause in order to do full and complete justice between the parties with respect to the subject-matter. This rule may, for the sake of convenience, be referred to as the "clean-up" principle of courts of equity. For the purpose of testing the application of this one general rule by the New Jersey courts it will be sufficient to analyze the cases falling within four headings: 1. Damages in Lieu of Specific Performance. 2. Damages in Addition to Specific Performance. 3. Damages in Addition to an Injunction against a Tort. 4. Damages in Lieu of an Injunction against a Tort.
